Stonebridge 1981: 'Don't burn it down - let's build!' The Brent Council v Leonard Johnson hearing

Paul Anderson, who worked with Leonard Johnson from the beginning of the project in 1981, was cross-examine don his witness statement by Ms Holland, Brent Council's Counsel.

He said he had attended a youth club on Stonebridge which put on lots of activities against the background of agitation and riots elsewhere in the country.

Anderson said that HPCC did have a written constitution, he had seen it and many activities were borne out of that constitution. 'We were young 20-22, and talented and worked with the CDA (Co-operative Development Agency). We couldn't have been part of Itec if we didn’t have a constitution.'

He could not give the exact date of the constitution but said it was produced around 1981-8.

Holland asked if it could have been the Steering Group constitution he was remembering. Anderson said, no, HPCC still had their own constitution. They had a General Meeting to elect people and had to put something together to say how they would operate. The constitution developed, 'We were active in stopping people destroying our community. We did it our way. Alice Holt (CDA) would have known what HPCC stood for, we were part of the Steering Group. We had so many activities that we had to have rules and regulations - we did it our way. We knew we had to have some sort of governance to the best of our understanding. As we developed, we got all sorts of professionals coming in to help is.'

He added, 'I'm passionate about this. It's an asset and they're trying to take it away.'

The Judge asked if there was any document that covered aims and objectives, financial controls, voting etc.

Paul Anderson said they did. They had to have a quorum and voted for chair, treasurer.  The contributed what they could. HPCC was on a learning curve - he was there.

Anderson was asked if he had the constitution with him. He said he hadn't brought it. He would have to look in the attic but they'd had a constitution to this this day.  He promised to try and get it for the court.

When he appeared to go off the point Ms Holland said sharply, 'Answer my questions. This isn't a street protest.'

Anderson said, 'I am a member of Bridge Park. I believe we own Bridge Park, we put a lot into it. Bridge Park belongs to the community.' He denied that there was any monetary in the case for him personally. He said he did not see himself reaping any financial benefit from the asset as it was for the community.

He continued, 'We had a vision to become self-sufficient. That's what we told the community: "Don't burn it down - let's build!" We campaigned to get the old bus garage, ran classes. When we got it, the message went out that this belongs to the community - not just to HPCC. We made the building what it is.'

Ms Holland asked about the vision, generation of revenue and aim for self-sufficiency within 5 years. She asked if Anderson was part of a project aiming to purchase the site.

Mr Anderson said the vision was making what the community wanted happen. A place for education, performance, training -'It was ours. People were inspired and helped to build the project.'

Holland said, 'You didn’t think you were owners. You could have sold it.'

Anderson said it hadn't crossed their minds that they could sell it.

Holland challenged, 'It didn't cross your minds because you didn't own it.'

Anderson: 'Nobody thought we'd sell it. It was the community's.'

The Judge intervened asking, 'You didn’t think the property was yours?'

Mr Anderson responded that they expected at one point they would get it. 'The message was that it was ours. We own it but we weren't going to sell it.'

Holland put it to him that they knew they didn't own the land but sometime in the future it could happen.

Anderson said he accepted that.

Holland continued, 'The anticipation was for the Community Co-operative, not HPCC.' Anderson replied that HPCC represented the community. Whatever mechanism allowed that to happen.'

Challenged by Counsel that only two mentions of his name could be found in documents and that he wasn’t involved in setting up Bridge Park, Anderson said there were many facets in the project and different roles. He was involved in the Itec and put his heart and soul into it: 'To see that taken away. Turned my back and it was gone. It was awful.'

He said he was not directly involved in meeting with the council [setting up Bridge Park] but involved in working with the DTI and council for the IT project.  He was not involved in setting up the HPCC but was a living witness of the campaign and getting the community behind the project. 'It was beautiful.'

Mr Cottle asked Anderson about a document written by representatives of the HPCC in July-October 1981 entitled, 'Realities of Life in Stonebridge' and another with the same title dated December 1981. Anderson said the two were slightly different.  The Stonebridge Bus Garage Steering Group document was more about what would be put in there, the other was a contextual report.

The next witness was former Labour councillor Bertha Joseph, who switched to the Conservatives in 2007.

Ms Joseph said that at a Labour Group meeting held when Merle Amory (now Abbott) was leader in 1986/87, Amory informed those present that HPCC was planning to buy the bus garage. Joseph had joined the council in 1986.

Holland pointed out that the garage had been bought by the council 4 years before - that didn’t make sense.  Joseph said she remembered Amory saying it at the time.

Holland suggested it was the Steering Group that could buy, not HPCC. Joseph said it was the HPCC that was around at the time. She had known about their work before becoming a councillor and the awful lot of work they did for young people at Bridge Park.  She was a 24-year-old councillor and had never heard that it belonged to the council. It was a community project. When the community heard that HPCC was buying the garage they were excited. The council didn’t have a connection with young people. She saw Leonard as the leader - the President.  The police had no control. There was no riot because of the project.

She added that taking it away now would be devastating for the community.

The next witness was Richard Gutch who had worked for the council but for a few years after he left continued to offer pro bono advice to the project when they requested it., and again more recently. He had met with the new project manager at the time and as an outside helped them assess contractors,

Gutch has asked to amend his witness statement because following Carolyn Downs' cross-examination he now knew the proposed development involved more than a swimming pool. He had thought it was a private development contrary to community use.

Ms Holland asked about the transfer of land to Brent Council from London Transport: 'Are you clear that Brent accepted the land?'

Gutch agreed but said HPCC were working very well as partners and when resources allowed would be legal owners. He understood that there was an expectation that they may be able to get a lease with an option to buy but that would be dependent on the project's sustainability. Brent were the legal owners.

Mr Gutch said that Johnson recognised that initially with help from funders Johnson recognised that that the land would be in the name of Brent. Gutch's advice was that it was great to have a vision but to take one step at a time.

Holland quoted a 1982 document with a factual statement that the council was purchasing the bus garage for this project. Gutch said, 'Yes but would be run and eventually purchased by HPCC.'

Ms Holland followed up stating it was always ultimately the council's property.  Gutch agreed and said as the council was making a contribution, they set out safeguards on how a potentially risk situation went.  Safeguarding ownership rested with Brent as was true of all Urban Projects.

Turning to the issue of Mr Watkins of Watts County Holland said that the significance of his meeting with him was about ownership.  Gutch said that Watkins had a number of facilities in Watts. He told HPCC that ownership enables you to do more things. It inspired Johnson and others to that aim.

Holland questioned Gutch again about ownership and the Urban Programme funds. Summing up she said that the asset was ultimately the council’s at the end of the day. Gutch agreed. She quoted GLC conditions, 'acquired for and controlled and run by the community.' Gutch agreed.

Gutch told Mr Cottle that he stood by his statement that it was 'not for the benefit of Brent [Council] in its own right.' The point was that it was being run by HPCC as a community-controlled project which had impressed funders who would not normally be politically sympathetic.

Both Counsels are preparing written submissions today and the hearing will continue tomorrow, (Thursday)

Day 2 - Brent Council v Bridge Park

The cross-examination of ex Brent Council Leader Thomas Bryson continued when the Court resumed this morning. Bridge Park's Counsel was trying to establish that the HPCC (Harlesden People's Community Co-operative) had the aim of eventually buying the freehold of the former bus depot site.  Bryson said that ownership of the land had not been discussed at presentations on the project. It was a partnership whereby both the Council and HPCC wanted it for the community. He knew of it as a long-term aim but did not sign up to it. He did not remember the purchase of the freehold by HPCC becoming a factor in any discussion.

The financial assistance had been for the HPCC and Brent Council was the conduit.  Asked about a note on the financial risk involved Bryson  said that any scheme had risks  - it was a fact of life - but concern was not expressed at any presentation. It involved a great amount of money without a great deal of experience in those proposing to run it. He assumed the council was satisfied with the organisation but couldn't remember.

Bryson agreed with the proposition that Stonebridge and the local area remained quiet because of the effects of the community project.  He said ownership of the freehold remained with the council, if that was to change there would have to be a buy out,

The next witness was Carolyn Downs, Brent Council's current Chief Executive. Having worked on the Inner Urban Programme for Haringey Council she said her understanding was that voluntary organisations worked with LAs in partnership and that the property never belonged to anyone but the council. Asked if the Department of the Environment would  judge whether monies went to private organisations, she that in the HPCC case it didn't. Brent couldn't buy the bus garage on its own but was expected to provide matched funding. Money was provided to purchase the asset and HPCC took the responsibility for running it.

Downs did not accept that Brent Council was merely a conduit for the cash - all Inner Urban Programmes had sponsors outside the council.  Challenged by Counsel that if HPCC had not applied the council would not be in the possession of the land, Downs said this was true of all Urban Programmes - everything the council does is for the benefit of the community. Since she had been employed by the council she had never regarded Bridge Park as a charitable asset,

On the issue of consultation with the community Downs said the council had employed an independent external company to consult with the community. Counsel quoted her 2017 statement that Brent Council was not going to negotiate with Brdige Park campaigners over the land ownership because there was nothing to negotiate about. Downs responded that the council had made numerous attempts to meet with the defendants.

Since 2013 plans had been changed to provide a larger facility in response to the community feedback.  Profits from the scheme would be invested locally, however litigation had halted a lot of the negotiations taking place. The £80m project had been on the point of signing. Counsel asked how much flexibility had GMH holdings shown over provision of business units and function rooms in the facility, At this point a council officer intervened to make a point about commercial confidentiality.  Counsel asked if it was possible to take the community on board via the charity but Downs said she could not speak for GMH.

Counsel suggested that Brent Council was taking a facility away from the community. Downs responded that this was not true - the community were getting a modern, enhanced facility and the council was remaining true to the Bridge Park legacy.

Questioned over demographic changes Downs said that Brent Council's job was to serve the community as it is now - not as it was in 1981.  Documents at the time had expressed concern that HPCC did not reflect the whole of the community.

Asked if it would have been possible for Brent Council to grant HPCC an interest in the land, Downs said, 'Yes, but it didn't.'

The next witness was Arthur Boulter (apologies if I did not get the spelling right - the name was not displayed on Skype) who is now 91 and was Director of Finance in Brent Council in 1981 having started with the borough in 1976.

Counsel asked Boulter about whether HPCC had obtained charitable status at the time. He said he wasn't involved in any discussion about that but if it had been a charitable trust it would have had to be kept separate in accounts otherwise it would have been picked up by the District Auditor.

He said Bridge Park was a corporate asset owened by the London Borough of Brent.  There was no discussion of the land being purchasd for charitable purposes. He dealt with the finances rather than the legal side, his job was to get the money.  Asked if Urban Aid was financial assistance for HPCC he said, 'No never! It was an application made by Brent, for Brent and for the purposes of Brent.'

Counsel asked if the money had to be passed on to HPCC. Boulter said that it was entirely within Brent Council. HPCC were not able to apply for it themselves. When Counsel suggested, 'They had to give it to HPCC. It was conditional that it went to HPCC.' Boulter said firmly, 'I don't agree.'

Urban Aid was directed at specific projects, in this case the purchase of the bus depot. Brent Council would have found it difficult to find the resources for the alternative course of action of buying the depot itself. Boulter said the facts were that Urban Aid was applied for and the council had got it along with money fro the GLC and other grants.

Boulter said that HPCC were extremely helpful in helping get Urban Aid for the council but he would not say that they had played a leading role. Everyone at the time wanted to promote harmony. Given the needs of the time it was extremely likely that Brent would have got the money with our without HPCC, although he acknowledged their contribution. He wasn;t aware the HPCC wanted to buy the freehold.

Boulter disageed with Counsel that this was an HPCC project, it was also Brent Council's whose aim was to benefit all the community. He said, I do not agree the bus garage was bought because of the assitance if HPCC, it was with their assistance.

The Judge asked if there was an obligation to pay back the 25%  required by Urban Aid; did Brent ever think to recover that from HPCC. Boulter said there was no intention of recocovering the funds but if HPCC had acquired the freehold the money would have come back to Brent. The GLC and other grant money would also have had to be repaid.

Merle Abbott (Amory) previously leader of Brent Council was the next witness.  She was elected for Stonebridge ward in a by-election in 1981. She was aware of the Hill Top Club on Stonebridge as  well as HPCC. She was aware of Leonard Johnson but no other HPCC members. With Brixton and Toxteth erupting they wanted to ensure it did not happen in Brent. She had heard that Mr Johnson took a microphone to disperse a crowd on the estate, although she had not seen that for herself.  At the time the council was going to all the estates where youth were disaffected. Johnson attended a meeting on the estate organised by David Haslma of Harlesden Methodist church and she would not wish to downplay Johnson's role in linking youth with the local authority. 

The council and HPCC worked together to purchase the garage site. HPCC had been really helpful in getting the money and they worked together to get a grant from the European Social Fund in 1982. They wanted to develop a project for the community.  Counsel reminded Abbott about a US visitor who spoke about enpowerment and control - the community should do things for themselves  rather than have things done for them.

It was not Abbott's understanding that HPCC wanted the freehold. She was a supporter of developing the garage as a community project, HPCC were active in presenting their joint  vision for a project that would benefit the community.  The mindset of national and local government (GLC) at the time was that they need to supoort projects in disadvantaged areas so she could not say that Brent would not have received the funding anyway, in view of what was happening nationally,  It had been Brent Council and HPCC campaigning together for the depot.

Abbott told Counsel that he was not making a distinction between HPCC and the community. There were other groups in the steering group apart from HPCC. HPCC was not The Community.  She said that she did not know that HPCC had aspirations to own the freehold but by 1982 she was deputy leader and less involved as she had wider responsibilites.

Cafe in the Park is Pie in the Sky - Let us have a library instead

A while back Sudbury Town Residents Association persuaded a Cafe owner to rename his business in Sudbury Town "Sudbury Tea Rooms". He spent money on new signage and promotion and invited locals for a free sampling.

They came for a freebie but rarely again. The place closed down soon after.

Amazingly someone else opened a new Cafe in the Parade in East Lane near Watford Road. Within weeks the business was under new management.

Those of us in the know were certain that the venture had no chance of success. Passing today I note the windows covered up and presumably the Cafe closed down.

A while back a girl started a cafe in Sudbury Town Station. She happens to be a relative of Merle Amory a Labour Leader of Brent Council briefly in the 1980s. She is no longer open every day as business is slack.

All of this sends a simple message - it is tough to make a success of running a Cafe in the Sudbury area - yet Brent Council officers still persist with their pie in the sky notion of a Cafe in Barham Park - even though they have done nothing about it for 13 months since the Barham Park Trustees were persuade to endorse this.

Key question is - are Brent Council Officers and Councillors so determined to stop local residents to open a Volunteer Library in Barham Park that they will pursue any delaying tactic possible or will they at long last stop wasting time and money and convert platitudes into some decisive action and let Friends of Barham Library get access to the empty Card Room in Barham Park? The Volunteers have even offered to provide refreshments besides the many other services local people need.
